Regulatory Implications of the Notary Data Re-Registration Circular: A Policy Analysis for Notaries

The problem of misuse of Notary accounts is not a new issue. However, the Directorate General of AHU's steps to resolve this issue by issuing a Circular on Notary Data Re-registration require further review. This is not only due to the controversy that has arisen, but also because of the crucial position and content of the circular before it is re-enacted. The research questions are: What is the position of the Notary Data Re-registration Circular within the Indonesian legal system? And What are the consequences of disharmony between the Circular Letter on Notary Data Re-registration and the Notary Law? This normative legal research utilizes primary, secondary, and tertiary legal materials obtained through literature review. The approach used is a statutory, conceptual, and case approach. The research found that the Notary Data Re-registration Circular is not in accordance with statutory regulations, the General Principles of Good Governance, its nature and function, nor with public legal awareness, and therefore must be revoked. Moreover, the implementation of this Circular Letter on Notary Data Re-Registration has created several burdensome implications for Notaries and even increased the workload of the Notaries’ MPD, MPW, and MPP. This study contributes to the discourse on administrative law regarding the limits of administrative officials' authority in formulating policy rules in the form of circulars.
