PELAKSANAAN PENYUSUNAN PROGAM PEMBENTUKAN PERATURAN DAERAH INISIATIF

The purpose of this research is to identify the implementation and to find outthe obstacles in the process of forming the initiative local regulations. One of thefunctions of the DPR is to form Regional Regulations, in the process carried out bydiscussing with the regional head and approving or disapproving the draft regionalregulation, proposing a draft regional regulation, and preparing a program for theformation of regional regulations with the regional head. Therefore, this study willexamine the implementation of the formation of regional regulations by the DPRDas an element of regional apparatus in the legislative process.At this writing the researchers based on the type of empirical juridical research.This research is descriptive qualitative, the approach used is an interactional/microapproach with qualitative analysis. Researchers used data collection techniques asfollows: literature study, observation, and interviews.The results of the study found that, in Law Number 12 of 2011 concerning theEstablishment of Legislations as amended by Law Number 15 of 2019 concerningAmendments to Law Number 12 of 2011 concerning the Establishment ofLegislations, especially Article 1 number 1 it is stated that the formation of lawsand regulations is the making of laws and regulations that include the stages ofplanning, drafting, discussing, ratifying or determining, and enacting. Although theprocess emphasizes the role of the DPRD, at least there must be provisions on therole or participation of the community in determining the plan for the formation ofinitiative regional regulations. In the practice of making initiative regionalregulations, various problems arise, including: the preparation of the initiative forthe establishment of regional regulations has not been based on a priority scale; theprogram for the formation of the initiative regional regulation only contains a listof the titles of the draft initiative regional regulations without being based on an indepthstudy as outlined in the information, explanations or academic texts of thedraft initiative regional regulations.Keywords : DPRD, Initiatives, Problems, Regional Regulations
