UPAYA PENERAPAN DIVERSI DALAM PERKARA LAKALANTAS PADA TINGKAT PENYIDIKAN DIWILAYAH HUKUM POLRES BAUBAU

This study aims to find out and analyze the obstacles faced by policeinvestigators in implementing the div for traffic accidents and to find out andanalyze the application of diversion to traffic accidents.The research method used is this type of research is empirical legalresearch. This research was conducted in Baubau City, namely Baubau CityPOLRES. The population in this study was taken from several communitymembers/families of victims and suspects and several investigators who werearound the Baubau POLRES legal area. The types of data collected in this studyare primary data and secondary data. Data collection techniques used in writingthis thesis are observation, interviews, and documentation. The method in thisstudy using qualitative methods.The results of the study indicate that not all cases of traffic accidentsinvolving children can be resolved through Diversion, because Diversion can berealized if it has fulfilled the conditions specified in the applicable regulations andthere is an agreement between the perpetrator and the victim for Diversion. Thelack of public understanding about diversion and the lack of clear and detailedregulation of compensation between perpetrators and victims who make diversionefforts in Law Number 11 of 2012 concerning the Juvenile Criminal JusticeSystem are important obstacles / obstacles in the process of implementing theDiversion.Keywords: Diversion, Traffic
