PENEGAKKAN HUKUM PIDANA DALAM MENAGGULANGI KEJAHATAN TINDAK PIDANA HASIL ILLEGAL LOGGING BERDASARKAN UNDANG-UNDANG NOMOR 18 TAHUN 2013 TENTANG PENCEGAHAN DAN PENGRUSAKAN HUTAN

This writing aims to find out: 1) How is criminal law enforcement intackling criminal acts resulting from illegal logging based on law number 18 of2013 concerning forest prevention and destruction (Case Study in Baubau City),and 2) Factors influencing enforcement criminal law in tackling criminal actsresulting from illegal logging based on law number 18 of 2013 concerning forestprevention and destruction (Case Study in Baubau City).The research method used is the type and source of the data obtainedthrough legal materials as primary data and supported by secondary data frombooks, laws and regulations and others. This study uses qualitative data analysis.The results of the study show that in dealing with crimes resultingfrom illegal logging based on Law Number 18 of 2013 concerning Prevention andDestruction of Forests (Case Study in Baubau City are: 1) Enforcement ofcriminal law in criminal acts resulting from illegal logging, there are no timberdocuments that transported in the form of a transportation memorandum andcertificate of ownership of teak wood rights processed by SKSHH which are legalin the Labalawa protected forest area based on the Decree of the Minister ofForestry of the Republic of Indonesia Number: SK.465/Menhut-II/2011 datedAugust 9, 2011, so that the perpetrators of criminal acts resulting from illegallogging uses transport memorandum documents and certificates of ownership ofteak wood rights from processed forest products that are not in accordance withtheir designation as regulated in laws and regulations., and 2) Factors that affectthe enforcement of criminal law in criminal acts resulting from illegal logging, theunavailability of a Technical Implementation Unit structure.
