PEMBUKTIAN UNSUR TINDAK PIDANA PENCURIAN DENGAN PEMBERATAN PADA TINGKAT PENYIDIKAN: (Studi Kasus Di Kepolisian Resor Boyolali)

The purpose of this study is to analyze the evidence of the elements of thecrime of theft by weighting at the investigation level and examine the obstacles.The background of the problem is that in the jurisdiction of the BoyolaliPolice, they have handled cases of theft with weights. This case is interesting tostudy, especially regarding the investigator's efforts to prove that there is an elementof weight in the theft case with the weighting.The research method used includes the type of research, namely normativejuridical which only examines secondary data. Secondary data required are lawsand other regulations relating to investigations as well as documents for cases oftheft with disapproval. The nature of the research is descriptive, the method ofcollecting data is by means of library studies and document studies. The dataanalysis method was carried out qualitatively.The results of the study concluded that proving the elements of the crimeof theft with weights at the investigation level was carried out by collectingevidence such as statements of witnesses, statements of suspects, and evidence. Allevidence and evidence of criminal acts that support the fulfillment of the elementsof a criminal act are obtained by procedures regulated in the criminal procedurallaw and other regulations related to the investigation. The existing obstacle is thelevel of difficulty in extracting information from witnesses because witnessstatements must really match one another so that the witness's testimony has valueas evidence.Keywords: Evidence, Crime of Theft With Weight, Boyolali Police.
