PENERAPAN RESTORATIVE JUSTICE DALAM PENYELESAIAN TINDAK PIDANA UMUM OLEH PENYIDIK POLRESTA SURAKARTA

The process of applying restorative justice to the settlement of generalcrimes handled by the investigators of the Surakarta Police, is appropriate andappropriate, where theoretically, restorative justice referred to in the provisionsabove is the settlement of criminal cases involving the perpetrator, victim, familyof the perpetrator/victim, and other related parties to jointly seek a just settlementby emphasizing restoration to its original state, and not retaliation. In accordancewith the principle of restorative justice, it cannot be interpreted as a method ofpeacefully ending cases, but more broadly to fulfill the sense of justice of all partiesinvolved in criminal cases through efforts that involve victims, perpetrators andlocal communities as well as investigators/investigators as mediators. Factors thatbecome obstacles in implementing Restorative Justice as an effort to resolve generalcrimes by Surakarta Police investigators are: 1) There is no agreement between thelitigants, 2) Cases handled are viral in the community, so that if Restorative Justiceis applied, it will lead to rejection. from the wider community 3) Indonesian peoplehave not been able to accept Restorative Justice. Suggestions for resolving casesthrough Restorative Justice that have been created and carried out so that lawenforcement parties are able to be consistent and introduce this method in the widercommunity.Keywords: Restorative Justice, Crime Settlement, General Crimes
