📄 Abstract

This study aims to examine the legal requirements of buying and selling inheritedland so as to obtain legal certainty, and legal certainty of the transfer of land rightsthrough buying and selling according to Government Regulation Number 24 of1997 concerning Land Registration. The results of this study are that 1) Theprocedure for transferring land rights through buying and selling based on PP no.24 of 1997 must meet material requirements and formal requirements. Materialrequirements are focused on the subject and object of the rights to be traded. Whilethe formal requirements for the sale and purchase of land rights must be proven bya deed of sale and purchase (AJB) drawn up by and before the official making theland deed, 2) To ensure legal certainty of the transfer of land rights through buyingand selling according to PP Number 24 of 1997, selling Purchases can only be madeon land owned based on land rights as evidenced by valid proof of ownership fromthe seller. Because with proof of ownership of land rights, it means that the selleris a person or party that is legal by law to sell.Keywords: Legality, Sale and Purchase, Inherited Land, Legal Certainty
