PENEGAKAN HUKUM KASUS KECELAKAN LALU-LINTAS DI WILAYAH HUKUM KEPOLISIAN RESORT KLATEN

The purpose of this study is to examine the process of taking actionagainst cases of traffic accidents that occurred in the jurisdiction of the KlatenPolice.The background of the research is that in the jurisdiction of the KlatenResort Police there has been a traffic accident case that resulted in the death ofanother person and knows the obstacles. Since the enactment of Law no. 22 of2009 concerning Road Traffic and Transportation, the case of a traffic accidentthat caused the death of another person has been clearly formulated with thefollowing elements: due to negligence, it causes a traffic accident that results inthe death of another person.The research method consists of: the type of normative juridical research,the nature of the descriptive research, the data required is secondary data withprimary legal materials, secondary legal materials and tertiary legal materials. Thedata collection method is carried out by means of a literature study by analyzinglegislation, legal theory, doctrine and cases of traffic accidents that result in thedeath of another person. The method of data analysis was carried out byqualitative analysis.The results of the study show that the action of accident cases resulting inthe death of another person is carried out by first handling steps at the scene of thecase, no arrests, detentions, searches of suspects, confiscation of evidence,examination of witnesses, suspects and a post-mortem. et repertum victim.Furthermore, the suspect is suspected of committing a crime in Article 310paragraph (4) of Law no. 22 of 2009 concerning Road Traffic and Transportation.There were no obstacles in the prosecution of the case.
