PERANAN MAJELIS PENGAWAS DAERAH (MPD) NOTARIS DALAM MENCEGAH TERJADINYA PERBUATAN MELAWAN HUKUM OLEH NOTARIS DI KABUPAATEN KARANGANYAR

Notary Supervisory Board is a body that is established by Minister of Lawand Human Rights of Republic of Indonesia that has the authority to carry outsupervision and guidance on the implementation of notary position based on UUNo 2 Tahun 2014 and on the inspection procedures of regional supervisoryboard (Majelis Pengawas Daerah) on notary based on the regulation of theMinister of Law and Human Rights number 15 year 2020. The problems of thisthesis were what was the role of Notary Regional Supervisory Board (MPD) insupervising the acts of notary that were against notary office law and what werethe procedures of regional supervisory board on notary by regional supervisoryboard.This was an empirical juridical research that consisted of research on legalidentification and on legal effectiveness.The method of this study was descriptiveanalysis that meant that this research was obtained from detailed and systematicdescription of the problems investigated.Secondary data collection was conductedby investigating various regulations concerning regional supervisory board insupervising the acts against the law by notary. Legal materials that were used inthis research comprising Kitab UndangUndang Hukum Perdata (Civil CodeLaw), Undang-UndangJabatanNotarisNomor 2 tahun 2014, and PeraturanMenteri Hukum dan HAM No 15 Tahun 2020( The Minister of Law and HumanRights regulation number 15 year 2020) regarding the procedures of examiningsupervisory board against a notary.The results of this study showed that the role of Notary RegionalSupervisory Board in Karanganyar Regency in guiding and supervising onnotaries was by implementing preventive and repressive supervision bypreventing the occurrence of notary office violation and guiding notary byconducting annual supervision on notary activities. The procedures of supervisionon notary conducted were based on the regulations but adapted to field conditions.Moreover, based on the results of this study, from 2018 to 2020, it was found thatthere were several supervision reports of regional supervisory board (MPD) thatwere brought to central supervisory board.Key words :notary, Regional Supervisory Board, supervision and legal certainty
