OPERASI TANGKAP TANGAN (OTT) DALAM PERKARA TINDAK PIDANA KORUPSI (STUDI PADA POLDA SULTRA)

This study aims to examine the arrangements and procedures for theimplementation of the preliminary investigation and investigation of Hand-CatchOperation (OTT) carried out by the Corruption Eradication Sub-Directorate ofDit. Reskrimsus Polda Sultra and to study and analyze the obstacles faced byCorruption Investigators, Dit. Reskrimsus Polda Sultra in handling OTT incorruption cases and efforts and solutions to overcome them.This study uses a normative juridical research method that is supportedby empirical data. This type of research is normative legal research and empiricallegal research. By using a statutory approach (statute approach) in conductingstudies of "The Hand-Catch Operation (OTT) in Corruption Crime Case (Study atPolda Sultra)". The nature of this research is descriptive. Normative legal researchthat focuses on library research and is based on secondary data, the sources oflegal materials used are: primary legal materials, secondary legal materials,tertiary legal materials. The data collection technique in this research is to uselibrary research techniques with data collection tools in the form of documentstudies from various sources that are considered relevant. The data analysis willbe done qualitatively.Based on the data analysis, the following results were obtained: (1)Instructions and procedures for the implementation of the Hand-Catch Operation(OTT) preliminary investigation and investigation conducted by the CorruptionEradication Sub-Directorate, Dit. Reskrimsus Polda Sultra, namely: (a) In the caseof preliminary investigations and investigations into criminal acts of corruption, itis actually regulated in the Anti-Corruption Act, however the preliminaryinvestigation and investigation of criminal acts still refers to the CriminalProcedure Code; (b) SOP for Preliminary Investigation and Corruption CrimeExamination as referred to in SOP for Preliminary Investigation at the Directorateof Corruption Crime, Bareskrim Polri No. SOP-DIT-TIPIDKOR-002 December2013 document. Meanwhile, the SOP for the investigation is regulated in the SOPfor Investigation at the Directorate of Corruption Crime, Bareskrim Polri No.SOP-DIT-TIPIDKOR-003 December 2013 document. In conducting OTT, theSaber Pungli Team of the Southeast Sulawesi Regional Police must follow theSOP.Keywords: OTT, Corruption, Polda Sultra
