PEMBENTUKAN PERATURAN HUKUM DAERAH YANG DEMOKRATIS OLEH PEMERINTAH DAERAH KOTA BAUBAU

The urgency of applying the principle of democratic openness in theformation of regional legal regulations by the local government of Baubau Cityand the implementation of the principle of Openness in the formation of regionalregulations of Baubau City, regional legal products in the form of regionalgovernment decisions and regional regulations can be trapped as legal productsthat are legally flawed, even though each formation Regional legal regulationsmust always pay attention to the concept of the rule of law, the principles ofopenness and democracy in the formation of statutory regulations, and generalprinciples of good legislation. So the writing of this thesis examines theapplication of statutory principles and the implementation of the formation ofregional legal regulations by local governments.The approach to be used is an empirical juridical approach. Researchbased on a positive law inventory, the discovery of legal principles and legalfindings, which is complemented by observations of the operationalization oflegal principles empirically in society.The existence of regional legal regulations in their formation by theregional government is in accordance with the principles of good legislation, inaccordance with Law of the Republic of Indonesia Number 10 of 2004 concerningthe Formation of Legislation.The principle of democracy has been applied in the formation of regionallegal regulations by the Regional Head which is contained in: the proposed draftregional regulations come from the Regional Government and DPRD; the processof making laws and regulations in a planned, integrated and systematic manner.Keywords: Establishment Of Local Legal Regulations, Application Of ThePrinciple Of Openness, Local Government.
