KAJIAN PENEGAKKAN HUKUM TERHADAP TINDAK PIDANA PENGANIAYAAN YANG MENYEBABKAN LUKA PADA TAHAP PERSIDANGAN

This research aims to, review and explain the enforcement of materialcrimes in the case of criminal mistreatment that caused injury in the verdict No.320/Pid.B/2016/PN Surakarta.Review and explain the extent of legal justiceagainst the criminal prosecution of persecution that caused injury in the verdictNo. 320/Pid.B/2016/PN Surakarta.The background of the law enforcement review of the crime ofmistreatment that led to injuries at the trial stage was based on the crime ofmistreatment that caused injury with defendant Bejo Bin Wiryono with the judge'sverdict giving a criminal penalty of 10 (ten) months in prison.This research is normative legal research, or conducted by examiningsecondary data sources, consisting of primary legal materials, secondary legalmaterials, and tertiary legal materials.. Data collection techniques used aredocument studies and literature studies, this research instrument is the verdictNo.320/Pid.B/2016/PN.Skt.The results of this study show that, first, the application of materialcriminal law to the crime of persecution that caused injury in VerdictNo.320/Pid.B/PN.Skt has fulfilled the elements in Article 351 paragraph (1) of thePenal Code, so that the Judge imposes a sentence of 10 (ten) months in prison tothe defendant.Second, the sentencing by the Judge in VerdictNo.320/Pid.B/PN.Skt has fulfilled the sense of justice based on the theory ofretributive justiceKeywords : Law Enforcement, criminal mistreatment, Trial Stage
