PENEGAKAN HUKUM TERHADAP PELAKU TINDAK PIDANA PERDAGANGAN ILEGAL SATWA LIAR YANG DILINDUNGI BERDASARKAN UNDANG-UNDANG NOMOR 5 TAHUN 1990 TENTANG KONSERVASI SUMBER DAYA ALAM HAYATI DAN EKOSISTEMNYA: (Studi Kasus di Wilayah Hukum Jawa Tengah)

The purpose of this research is to assess and analyze law enforcement againstperpetrators of illegal trade of wildlife protected under Law No. 5 of 1990 on theconservation of natural resources and ecosystems in Central Java law. To assessand analyse law enforcement barriers in implementing law enforcement againstperpetrators of illegal wildlife trade crimes protected under Law No. 5 of 1990 onthe conservation of natural resources and ecosystems in Central Java law.The method of approach in writing is sociological juridical. The specificationof this research uses analytical descriptive. Data sources use primary data andskunder data. Data collection techniques using interview studies, Focus GroupDiscussion and observation. To analyze the data, researchers use qualitativedescriptive analysis methods.Based on the results of the research concluded that law enforcement againstperpetrators of criminal acts of hunting and trade of protected wildlife in the regionof Central Java Natural Resources Conservation Center is still very weak thishappens because: in the absence of compassion and humanitarian considerations,there are certain persons who play to relieve punishment, very wide area of naturalResources Conservation Hall of Central Java with very limited personnel or evenless and limited operational funds. The constraints faced in law enforcementagainst perpetrators of criminal acts of hunting and illegal wildlife trade in theregion of Central Java Natural Resources Conservation Hall are: lack ofcoordination with related apparatus in connection with the handling of protectedanimal hunting so that the case does not arrive at the investigation due to theconstraints of no suspect, the suspect fled (DPO), the evidence can not be identifiedbecause it is Efforts to overcome the constraints are: the handling of conflictsbetween human beings with good and complete animals, the involvement of theparties to overcome the hunting of animals that are protected both forestry, localgovernment and community officials, counseling and socialization, improving andempowering the economic Community around the region, thorough investigationof the hunting of protected animals.Keywords: law enforcement, criminal offence, illegal trade of wildlife protected.
