Kajian Hukum Penyelesaian Pembagian Harta Bersama Berdasarkan Perjanjian Dibawah Tangan Setelah Putusan Cerai

This study aims to determine and analyze the validity of private agreements regarding the division of joint property after a divorce decision and to determine and analyze whether they are contrary to applicable regulations. This type of research uses juridical-normative legal research, with a qualitative legal material analysis technique. The types and sources of legal materials in this study consist of primary legal materials, secondary legal materials, and primary legal materials. The legal material collection technique is a literature study technique, obtained from secondary legal materials through the collection of legal materials and investigation of legal materials in the literature. The research approach used is a case approach and a statute approach. The results of the study on the division of joint assets after the divorce decree Number: 248/Pdt.G/2023/PA.Sal registered on September 5, 2023 and decided on September 18, 2023 between Ngadiyem binti Darmowikromo and Suparji bin Mulrejo as stated in the Joint Asset Division Agreement dated October 24, 2023 made in Salatiga City based on an agreement can be implemented because based on the valid requirements of the agreement in Article 1320 of the Civil Code has fulfilled its elements.
