Dampak Ovecrowded Terhadap Pemenuhan Hak Pelayanan Kesehatan Narapidana Berpenyakit Menular di Lembaga Kelas II B Tanjung Balai Asahan

Overcrowding or overcapacity in correctional institutions is a serious problem that directly impacts the fulfilment of prisoners' basic rights, particularly their right to health care. The Tanjung Balai Asahan Class IIB Correctional Institution currently houses 1,127 prisoners, exceeding its official capacity of 707. This situation creates obstacles in the implementation of health care policies, especially for prisoners suffering from infectious diseases such as HIV/AIDS, tuberculosis, hepatitis, and sexually transmitted infections. This study uses empirical legal research methods with a qualitative approach through interviews, direct observation, and documentation to describe the factual conditions in the field. The results show that overcrowding causes health services to be ineffective and uneven. Limited medical personnel, minimal isolation facilities, and inadequate polyclinic facilities are the main obstacles. Administrative barriers and budget constraints exacerbate the situation. Although the prison has attempted to provide isolation rooms, collaborate with the Health Office, and conduct regular health checks, these measures have not been optimal. Monitoring systems such as SDP Watkesrehab have begun to be implemented, but still require further evaluation. Overall, the implementation of health care policies by the Directorate General of Corrections has not been fully realised, meaning that prisoners' rights to health care, particularly those suffering from infectious diseases, have not been adequately fulfilled due to various internal and external obstacles.
