Reformasi Hukum dalam Cengkeraman Oligarki: Menelusuri Kesenjangan Legitimasi Konstitusional dan Kepentingan Elite

Post-New Order legal reform in Indonesia was initially expected to serve as a cornerstone for establishing a democratic, accountable, and constitutional legal system. However, in practice, the direction of legal reform has shown a regressive tendency due to the dominance of oligarchic interests, manifested through strategic alliances between political elites and corporate actors.This study aims to analyze how oligarchic domination influences the trajectory of legal reform in Indonesia, particularly in the legislative process and the formation of statutory regulations. It also seeks to examine the extent to which the gap between the principles of constitutional legitimacy and legislative practices contributes to a crisis of public trust. The research adopts a normative juridical approach, involving analysis of legislation, Constitutional Court decisions, as well as secondary data from surveys and civil society reports. The findings reveal that legislative processes frequently violate the principles of public participation and social justice, as exemplified by problematic laws such as the Omnibus Law on Job Creation. There is a discernible dominance of elite interests within the substance of such laws, alongside the prevalence of lobbying practices and the insertion of interest-driven clauses. This condition has led to a declining level of public trust in the House of Representatives and the legal system as a whole. Systemic reform is therefore urgently needed, including the strengthening of meaningful public participation, enhancing legislative transparency, and enforcing robust oversight from the Constitutional Court, the Judicial Commission, and civil society. Only through such comprehensive measures can legal reform truly align with constitutional values and serve the interests of the people.
